This application is not in accordance with Cornwall Local Plan Policy 12 Part 2 as it does not protect individuals and property from overlooking and unreasonable loss of privacy and overshadowing and overbearing impacts. This application is not in accordance with Lostwithiel Neighbourhood Development Plan Policy HH5 as there is no provision for this proposed three bedroomed property to have two off street parking spaces. The loss of garden for number 8 Mill Hill means that both 8 Mill Hill and this proposed property will have no amenity space. The area described as a courtyard is a very dark path with a right of way running through it. The use of this right of way will adversely impact the residents of this proposed dwelling (www.defra.gov.uk Rights of Way circular 1/09). The Town Council is of the opinion that this proposal is overdevelopment of the site and that the application has inaccuracies. Furthermore the adjoining bank is steep and unstable. |
